General Terms and Conditions of Use and Rental Conditions
1. Introduction
This document sets out the general conditions for the provision of holiday rental services that Villa Del Mar offers to its guests in the villas that it manages exclusively and in their entirety, as well as in those villas in which Villa Del Mar Villas only assists the owner in the management of the holiday rental of his or her villa.
The general booking conditions of the villas, which are set out below, form an integral part of the contract between the guest (hereinafter: ‘guest’, ‘you’, ‘you’, ‘your’, ‘yours’ or ‘your’) and Villa Del Mar Villas,

This acceptance is independent of the booking channel through which the reservation has been made: Villa Del Mar telephone booking centre, Villa Del Mar web page (www.rentals.traveldelmar.es) or through external booking centres or web pages of other agencies or tour operators with which Villa Del Mar has collaboration agreements.
2. Prices
The prices of our catalogue of villas, houses and flats are fixed on a daily and weekly basis and according to the prices indicated on our website for each villa.
The prices published for daily or weekly rentals vary depending on the week chosen and may include discounts or special offers. These prices are clearly indicated in the villa description on our website rentals.traveldelmar.es Prices, minimum stay and arrival dates may vary depending on the season, so we recommend you check our website for dates.
The prices include the provision of the accommodation, the tax costs associated with the house (VAT, municipal, community or tourist taxes, if applicable), water costs, electricity costs, administration costs, pool and garden maintenance, as well as final cleaning and periodic intermediate cleaning of the villa. The intermediate cleaning is included for stays of more than ONE (1) week and is offered to the guests personally during the weekly courtesy visit of the Villa Del Mar staff.
Possible additional costs for extra equipment not included in the villa, such as extra beds, fans, cots, high chairs, as well as surcharges for accommodating pets in the villas, etc. are not included in the price, unless expressly stated in the description of the villa booked on the Villa Del Mar website.
3. Booking and payment conditions
3.1. Subject of the contract
The reservation and the contract are concluded exclusively for tourism purposes and not for commercial, event organisation, promotional or other purposes. For this reason, any liability to companies or individuals for damages arising from loss of business or any other non-tourism related activity is excluded.
3.2. Booking methods
Reservations for rental accommodation can be made by telephone, email or through the website https://rentals.traveldelmar.es/alquiler/alquiler- alquileres-d0/. However, the reservation is not considered finalised until Villa Del Mar has received the first payment for the reservation from the guest.
3.3. Method of payment
Payments can be made by bank transfer or credit card (credit or debit card, except American Express).
The following means of payment are not accepted Bank cheques, holiday cheques or cash payments.
3.4. Tariff
Villa Del Mar offers rates with different prices and cancellation conditions. During the booking process, the guest can select the desired rate and commit to the corresponding price and cancellation policy. The guest can contact Villa Del Mar's reservation department within 2 days and request a change in the selected rate (phone:
+34 965 830 700 ; e-mail: service@villadelmar.es After this period, the selected rate cannot be changed.
3.5. Payment plans
The guest has several payment plans available:
3.5.1. Payment 10 % - 90 %: 10 % is payable at the end of the booking and the remaining 90 % at the latest 31 days before the date of arrival.
3.5.2. Payment 50% - 50%: 50% is paid at the end of the booking and the remaining 50% at the latest 7 days before the date of arrival.
3.5.3. Monthly: First payment on the day of booking, then monthly payments in the following months (the date of the monthly payments is calculated according to the day of arrival), the last payment to be made at least 7 days before the date of arrival.
3.5.4. One-off payment: The total amount is payable at the time of booking.
3.6. Availability of payment plans
The availability of the above payment plans depends on the number of days between the booking date and the actual start of the stay:
3.6.1. If the booking is made more than 180 days (6 months) before the arrival date, only the options listed in 3.5.1., 3.5.3. and 3.5.4. can be selected.
3.6.2. If the reservation is made between 180 days (6 months) and 31 days (1 month) in advance of the date of arrival, only the options listed in points 3.5.1. and 3.5.4. may be selected.
3.6.3. If the booking is confirmed between 30 and 7 days before the day of arrival, only the options listed in points 3.5.2. and 3.5.4. may be selected.
3.6.4. If the booking is made less than 7 days before the day of arrival, only the payment option indicated in point 3.5.4 can be selected.
3.7. Terms of payment
The payment terms are specified in the booking confirmation and the keys can only be handed over once Villa Del Mar has received the full amount of the booking. In case of payment by bank transfer, if the full amount has not been received by the time of arrival, the guest's credit card will be blocked with the outstanding amount, in addition to the security deposit that has already been blocked (see ‘6. Security deposit’). This block will be lifted as soon as payment is received. If the outstanding amount is not received, the full amount of the security deposit will be charged as a guarantee for this payment. If the guest does not have a credit card, the outstanding amount will be charged by debit card and refunded upon receipt of the transfer.
3.8. Cancellation of the booking due to non-compliance with payment conditions
In the event that the guest exceeds any of the above deadlines by more than 3 working days, the reservation will be automatically cancelled. Villa Del Mar undertakes to send reminders of non-payment and notices of impending cancellation by email to the guest in order to avoid delays in payment due to forgetfulness.
3.9. Extension of stay
If the guest wishes to extend their stay in the villa they have booked and arrives or departs before or after the date initially indicated, this can be requested at Villa Del Mar's reservations department. Provided that the booked villa is available on the requested dates. The additional nights will be charged at the predetermined price for the period in question, taking into account any offers or discounts.
3.10. Shortening the stay
If the guest decides to shorten their stay for any reason, they will not receive a refund, as the stay has been booked for them in full and is linked to the number of nights specified in the contract.
3.11. Request for change of villa by the guest
No change of villa is permitted in a confirmed booking, except in the cases listed in clause 11.
3.12. Request for change of travel dates by the guest
If the guest wishes to keep the same number of nights and the same villa as their booking, but wishes to change their stay to a period earlier than originally planned, they must comply with the following conditions.
3.12.1. If the guest wishes to change his stay to an earlier period and the villa is available, the change will be made if the restrictions of the villa in question are met. If this entails an increase in the amount of the reservation, the guest is obliged to pay this before the start of their stay. In no case will the amount of the original booking be reduced or any part of the amount paid be refunded.
3.12.2. If the guest wishes to divide the nights of their stay into two or more periods and the villa is available, Villa Del Mar will consider the request but reserves the right to refuse it. If the request is accepted, the respective periods must meet the minimum length of stay and will be treated as individual date changes. Each period will be treated as a booking and must comply with the conditions of point a. of the section on requesting a change of travel dates. In addition, the corresponding administrative costs arising from such a change will be charged.
3.13. Non-appearance of the guest ( No Show )
If the guest does not show up 24 hours after the start of the booked stay or has not indicated the exact day of arrival for the booked stay, we will consider the booking to be cancelled and no discount will be granted on the total amount of the booking or any refund.
4. Cancellation fees and cancellation conditions
Cancellation charges depend on the method of booking and the type of rate.
4.1. Booking method
Guests who have booked through a travel agency or tour operator are subject to the cancellation conditions of the respective intermediary.
If the booking was made directly through Villa Del Mar, the cancellation policy depends on the type of rate selected by the guest.
4.2. Types of rates
4.2.1. Best price
Non-refundable cancellation, except in the cases listed in our cancellation policy for specific government restrictions, which allow for a full refund of the amount paid.
4.2.2. Flexible rate
For cancellations made up to FOURTEEN (14) days prior to arrival, regardless of the reason, the reservation holder will receive a voucher for the full amount paid, which can be exchanged for another stay in a villa. Vouchers expire on 31 December of the year following the date of cancellation of the original booking.
In addition, the full amount paid may be refunded, provided that the reason for cancellation is stated in our cancellation conditions in case of specific official restrictions.
4.2.3. Maximum security
For cancellations up to FOURTEEN (14) days prior to arrival, regardless of the reason, the reservation holder can choose between a refund of the amount paid minus the cancellation fee (8% of the total amount of the reservation) or a voucher for 100% of the amount paid.
In addition, the full amount paid may be refunded, provided that the reason for cancellation is stated in our cancellation conditions in case of specific official restrictions.
5. Cancellation conditions in case of specific official restrictions
Villa Del Mar will refund the total amount paid for all rates if the booked stay cannot take place for one of the following reasons:
- Quarantine of at least SEVEN (7) days upon entry into Spain. - Temporary border closure (border of the country of origin or destination Spain). - Regional closure whereby entry into the Valencian Community is not possible. - Sectoral closure (prohibition to rent holiday accommodation in Spain or in the province of Alicante).
Period for cancellations due to specific government restrictions: Between FOURTEEN (14) and SEVEN (7) days prior to the date of arrival or the day prior to arrival if the reason for the cancellation arises within the last (SEVEN) 7 days prior to the planned arrival.
6. Deposit
A security deposit must be paid at the time of booking to guarantee Deposit Houses 600 € and
Flats 400 € the proper use and maintenance of the furniture and furnishings, as well as the conditions of use and departure.
This amount will be retained on the guest's credit card on the day of arrival and will only be debited from the guest's account in the event of non-compliance with the conditions of departure and/or the conditions of use of the villa. If the guest does not have a credit card, the amount of the deposit will be charged to the guest's debit card.
The deposit will be released or refunded one week (working days only) after departure, as soon as the accommodation has been checked to ensure that it is in perfect condition.
7. Specific conditions for long term bookings
Bookings with a duration of more than SIXTY (60) nights are considered long term bookings and their costs are in accordance with the prices shown on the website of the villa booked in the section ‘Long term stay’.

7.1. Price for long term bookings
Guests who have booked through a travel agency or tour operator are subject to their cancellation policy. The published monthly rates for long stays vary according to the selected month and do not allow for any discount. 8. Arrival
Villa Del Mar requires an online registration form to be submitted to the local police authorities, which must be completed online 14 days prior to arrival (registration form).
Check-in time is from 16:30. On arrival at the villa, the guest must have already paid the full amount of their booking, including any additional services booked, in order to collect the keys (address, date and time are indicated on the booking confirmation).
The keys must be handed over at the destination address indicated in the contract. For security reasons, cleaning crews cannot let guests into the villa if check-in has not yet taken place.
If the guest arrives later than the time stated in the contract, he/she must contact Villa Del Mar to arrange for the keys to be handed over. Once the late check-in has been completed and the deposit for your stay has been blocked on your credit card, the guest will receive a set of keys to the villa they have booked.
9. Departure from the villa
In the event that the guest has not left the villa by the specified check-out time, Villa Del Mar may charge an additional cost of up to one day's stay, as this would significantly affect our cleaning and quality control procedures for that day.
If, after checking the property, serious damage is discovered or valuables are missing from the villa,
the value of the damage incurred will be debited from the guest's security deposit, the maximum amount corresponding to the amount set as a security deposit. Villa Del Mar will contact the guest after debiting the corresponding amount according to the damage suffered or the non-fulfilment of the contractual obligations and inform him/her of the reason for the additional debit. If the cost of the damage caused by the guest exceeds the amount of the deposit, the guest will be informed by e-mail or telephone. If no agreement is reached, legal action will be taken in accordance with clause XIV.
10. Terms and conditions of use
10.1. Guest's liability
The guest who rents accommodation for other persons (in addition to himself/herself) is liable for payment of the full rental price and for damages caused by his/her behaviour and that of the other persons staying with him/her in the rented accommodation. However, the legal liability applies to all guests of the villa, from whom the full amount of the group's damage can be claimed, regardless of which person in the group has caused the damage.
10.2. Maximum number of persons
The booking is valid for the maximum number of persons indicated on the booking form and in the contract. The accommodation may not be occupied by more persons than indicated. Otherwise, the rental contract may be terminated and the deposit forfeited. In this case, the amounts already paid will not be refunded and the guest will have to pay the full amount of the rent.
10.3. Celebrations and festivals
Parties and/or celebrations are not permitted in the reserved villa under any circumstances. If the guest invites persons to the villa who are not included in the reservation, the number of participants must in any case be equal to or less than the maximum number of persons permitted in the villa, and the relevant conditions of the reservation must be observed.
The timetables and applicable regulations of the corresponding locality must be taken into account, as well as the correct and peaceful coexistence with the neighbours adjoining the reserved villa.
Failure to comply with clauses 10.2 and/or 10.3 entitles Villa Del Mar to cancel the reservation with immediate effect, without the reservation holder being entitled to a refund of the total amount agreed for the reservation (whether or not it has been paid in full). This cancellation must be made in writing and in such a way that the notification can be accredited (by e-mail to the reservation holder, by SMS to the telephone number provided, etc.).
If Villa Del Mar exercises this right, the guest of the booked villa shall not be entitled to stay in the villa and must leave the villa at the time of request.
If the guest refuses to leave the villa after being requested to do so by Villa Del Mar, he/she will be obliged to pay a penalty of double the daily rate of the booked villa for each day he/she remains in the villa without permission.
Furthermore, any damage and/or damage caused as a result of parties and/or celebrations in the villa shall be the responsibility of the guest(s) of the villa, who may be required to pay the full cost of repairing the damage caused, irrespective of the person(s) causing the damage.
The rental of villas by companies or individuals for parties, events and/or celebrations is strictly prohibited, regardless of the number of people attending, and will give rise to the sanctions described in the previous paragraphs.
10.4. Smoking inside the flat is prohibited.
Smoking is only permitted in the outdoor areas of the villas.
Open fires (candles / fireplaces) are not permitted inside the villas.
10.5. Pets
In order to accommodate pets in one of our villas, guests must first ensure that pets are allowed in their chosen property.

Each pet must be declared at the time of booking and a supplement of 35 euros per pet will be charged. If Villa Del Mar or its suppliers discover that the guest has accommodated one or more pets without declaring them at the time of booking and that they are not allowed in the villa, Villa Del Mar has the right to automatically cancel the booking and the guest must leave the villa within a maximum of EIGHT (8) hours. If this occurs in a villa where pets are allowed, Villa Del Mar will not demand the cancellation of the stay in the villa, but may charge a penalty for non-compliance of three times the price established for the accommodation of pets.
10.6. Access to the property
During the stay, the villa may only be used by guests. However, during their stay, guests must allow access to Villa Del Mar staff or its suppliers to check compliance with the obligations set out in this document and to carry out intermediate cleaning (for stays of more than ONE (1) week), cleaning of the pool and garden, repairs or any activity arising from any incident on the property during their stay. Villa Del Mar staff will always knock on the door of the villa at least twice before entering and will only use the key if the guest does not answer. This can, however, be pre-arranged by telephone or text message to the guest.
10.7. Dangers or justifiable reasons for serious damage to property
Villa Del Mar reserves the right to cancel or terminate the rental contract in the event of danger or justified reasons
there is reason to believe that the guest may cause serious damage to the property. Failure to comply with the conditions of use and/or departure will result in automatic termination of the contract and forfeiture of the security deposit.
10.8. Energy

The cost of energy consumption is 10 kilowatts per day included in the rental price for apartments and 20 kilowatts per day included for villas. Additional consumption is charged at € 00.45 per kW. The extra electricity consumed will be charged on the day of departure and is payable in cash or credit card. All guests are requested to use heating, air conditioning and energy in general responsibly and sensibly.
10.9. Cleaning costs
The costs of final cleaning and intermediate cleaning (for stays of more than ONE (1) week) are included in the price of the booking and are determined in accordance with the conditions of use in clause VIII.
10.10. Key to the property
The guest receives a full copy of the keys to the property. No additional keys will be issued.
10.11. Additional services
Guests can contact the booking department for advice, to make a reservation or to arrange various additional services for their stay, such as
- Additional equipment (extra beds, cots, highchairs, fans, pool towels)
- Laundry and dry cleaning
- Specialised cleaning
- Car, motorbike and bicycle hire
- Airport transfers and taxi booking
We recommend that our guests contact us well in advance to ensure that these services are available at the beginning or during their stay.

11. Modification or cancellation of the booking due to causes unforeseeable by Villa Del Mar
Villa Del Mar reserves the right to replace the accommodation with an equivalent accommodation in the event of serious unforeseeable events that prevent the guest from staying in the planned villa. If it is not possible to replace the planned villa with an equivalent or if it is not to the guest's liking, Villa Del Mar will offer the guest the option of changing the travel date or cancelling the booking, in which case Villa Del Mar will refund the full amount paid.

12. Services and responsibilities
Except for transcription errors, the information on the description of the accommodation is given in good faith based on visits to the villa and information provided by the owner. Villa Del Mar is responsible for the fact that the description of the villa corresponds to its general characteristics, the guest accepting that there may be individual changes in the equipment as a result of normal use, such as electrical appliances, outdoor furniture or items of equipment that are renewed periodically.
Villa Del Mar accepts no responsibility for any changes that may occur to the accommodation or its surroundings that are not directly attributable to Villa Del Mar. This means that the guest accepts that he/she will not receive any compensation as a result of the changes.
The guest may claim compensation for subsequent irregularities, provided that these could not have been avoided by Villa Del Mar or were foreseeable.
Villa Del Mar is not liable for errors in the description provided by the tour operator or external agencies. Once the guest has signed a contract with a tour operator or agency, it is essential that the guest checks the exact description of the property on the website of Villa Del Mar, which is ultimately responsible for the guest's stay.
12.1. Building works
The accommodations are usually privately owned by several individual owners and are often located in large residential areas, so there may be unexpected construction works in the immediate vicinity. These construction works are carried out by property owners, construction companies or governmental institutions that have no connection with us and Villa Del Mar has no influence on these activities. Consequently, upon completion of the booking of the villa, the guest accepts that neither Villa Del Mar nor the owner of the villa accepts any liability for any inconvenience caused by construction works that are not carried out by the accommodation provider.
12.2. Satellite/Cable TV
If satellite or cable TV is indicated in the description, this does not automatically mean that all programmes can be received. The owners, who come from different countries, have decoders that do not always receive all international channels, but only a selection of them.
12.3. Water, electricity and internet
In the event of occasional water, electricity and/or internet cuts caused by local or regional authorities and/or suppliers, the guest agrees that neither Villa Del Mar nor the owner of the villa shall be liable for any inconvenience or damage caused by such restrictions.
12.4. Accidents and theft
Neither Villa Del Mar nor the owner of the accommodation accepts responsibility for any damage (injury, illness, death, property damage or theft) suffered by the guest or their companions during their stay. By making a booking, the guest agrees to take responsibility for their personal safety and belongings and excludes any liability on the part of Villa Del Mar and the villa owner. In order to minimise potential risks, guests are asked to take special care when using the kitchen and swimming pool, as these are areas of the property that pose additional risks to the guest.
In addition, they should ensure that all doors and windows of the property are securely closed. Compliance with these instructions is especially recommended if guests include children and/or elderly persons.
13. Suggestions and incidents
Villa Del Mar has a preventive and corrective system for detecting incidents that is developed during the winter months, as well as a system of weekly reviews of the control points established on the property.
Through these procedures, we prevent and/or investigate most of the incidents in our offered properties to ensure you a trouble-free stay. In addition, we would be grateful if you would inform us by telephone, email service@villadelmar.es or in person at our offices of any incidents or suggestions that do not have a significant impact on your stay but which may be useful to us in improving our service to our guests.
Due to the full occupancy of our villas during the summer months, despite our policy of quality and service, there may be isolated incidents that we have not identified in the villa where you are staying. If this is the case, we kindly ask you to inform us during the first 48 hours of your stay via our e-mail service@villadelmar.es or by telephone ( + 34 96 583 0700 ) so that we can solve the problem as soon as possible and minimise the inconvenience during your stay. After the first 48 hours of the stay, the guest loses the right to complain about any deficiency detected before arrival. This instruction is necessary to avoid any damage or defects caused by previous guests that have not been detected during the inspection carried out by our team.
It is important that the guest understands and accepts that the occurrence of incidents is inherent in the use of the property and that incidents are occasionally unpredictable (such as septic tank problems, boiler problems, damaged taps, electrical faults, etc.) or beyond our control (such as general power cuts, building works in the neighbourhood, noise from neighbours or animals, presence of insects, etc.).
The Villa Del Mar team will do everything in their power to resolve or minimise the impact of any incident during your stay. However, by completing the booking, the guest accepts that Villa Del Mar is only responsible for incidents that are within Villa Del Mar's control and that Villa Del Mar has the actual ability to resolve during the guest's stay. Furthermore, the guest accepts that the resolution of certain incidents - especially in high season - may take longer than desired by the guest, as this requires the assistance of specialised suppliers and their response time is not guaranteed.
We ask our guests to cooperate as much as possible in the investigation of incidents and to be accurate in their reporting. In addition, we ask that you report incidents to our team in a polite and constructive manner, as your willingness to resolve the problem is in good faith. However, this requires your full cooperation and respect.
Incidents should be reported by telephone (+34 965 83 0700) or by email service@villadelmar.es, not through intermediary agencies.
If the incident is not satisfactorily resolved within 48 hours of telephone communication, the guest may complain in writing via our email service@villadelmar.es. If the guest changes Villa Del Mar accommodation or leaves the rented accommodation prematurely without consulting Villa Del Mar, he/she will lose all cancellation rights to which he/she may potentially be entitled.
14. Validity and jurisdiction
The contractual relationship shall be subject to the Courts of Denia (Alicante) in case of any dispute or claim that may arise between the parties in relation to the stay in our villas.
15. Data protection
In accordance with Organic Law 15/1999 on the Protection of Personal Data, you are informed that this company will include your data in an automated guest file for the purposes of the commercial relationship and for subsequent information, and that your data may be transferred to third parties in the cases regulated by law, such as auditors, competent administrative bodies for the purposes of control, registration and auditing, and notaries public for the notarisation of documents.
We also inform you that you can exercise your rights of access, rectification, cancellation, portability, limitation or opposition to the processing of your data, as well as revoke the consent given, by sending a written communication to Villa Del Mar / Relax Travel & Villa S.L. to the following address: Calle Corbeta 10 , Edificio Apolo / Local 3 in 03710 Calpe- ALICANTE - SPAIN, attaching a photocopy of your ID card (front and back) or sending your communication and a scan of said ID card by email to service@villadelmar.es.
